Art. 1

De huidige voorwaarden gelden voor alle overeenkomsten tussen CCSI advice BV en haar klanten, voor zover niet anders is bepaald door de bijzondere voorwaarden of overeenkomsten. Elke bestelling houdt de aanvaarding door de klant van onze algemene voorwaarden in.

Art. 2

De toepasselijkheid van eventuele aankoop- of andere voorwaarden van de wederpartij wordt uitdrukkelijk uitgesloten.

Art. 3

Indien één of meer bepalingen van deze algemene voorwaarden op enig moment geheel of gedeeltelijk nietig worden verklaard, blijven de overige bepalingen van deze algemene voorwaarden volledig van toepassing. Verkoper en koper zullen in onderling overleg nieuwe regels op te stellen om de nietig verklaarde bepalingen te vervangen, voor zover mogelijk het doel en de strekking van de oorspronkelijke bepalingen in acht worden genomen.

Art. 4

Als er onduidelijkheid bestaat over de interpretatie van één of meerdere bepalingen van deze algemene voorwaarden, dan zal deze plaatsvinden in de geest van deze bepalingen.

Art. 5

Na bevestiging is het niet mogelijk een geplande coaching/consulting sessie af te zeggen uiterlijk binnen 48 u. Annulering per telefoon of sms dient steeds te worden bevestigd via e-mail.

Bij latere afzegging wordt het volledig honorarium in rekening gebracht voor de geplande tijd. Coach/consultant, coachee/client en opdrachtgever houden zich uiteraard ook aan de afspraken.

Art. 6

Alle facturen zijn betaalbaar op 7 kalenderdagen na de facturatiedatum tenzij een andere termijn werd overeengekomen, in euro.

Art. 7

Per maand wordt een nieuwe factuur verstuurd. Alle voorgestelde betalingen moeten betaald worden binnen de voorziene betalingsdatum.

Art. 8

In geval van niet-betaling of laattijdige betaling zal de prijs van rechtswege en zonder dat enige ingebrekestelling nodig is, worden verhoogd met een forfaitaire vergoeding van 15%, met een minimum van 100,00 EUR. Daarenboven is, van rechtswege en zonder dat enige ingebrekestelling nodig is, een nalatigheidsintrest verschuldigd, die zal berekend worden overeenkomstig de Wet van 2 augustus 2002 inzake de betalingsachterstand bij handelstransacties (handelaren).

Voor particulieren zal een nalatigheidsintrest van 12% aangerekend worden.

Art. 9

Elke niet-betaling van een factuur op de vervaldatum of elke wanbetaling brengt de eisbaarheid mee van de, zelfs niet vervallen, facturen die op dat moment reeds werden opgesteld en overgemaakt aan de cliënt en doet elke betalingsfaciliteit of korting bij contante betaling voor de toekomst automatisch vervallen. De verkoper kan zich – bij gebreke aan betaling – beroepen op art. 1184 B.W.

Art. 10

Alle klachten betreffende facturen moeten CCSI advice BVBA bereiken via aangetekend schrijven binnen de 8 kalenderdagen na de factuurdatum, met referentie naar het factuurnummer. Na het verstrijken van deze termijn, wordt de klacht niet in aanmerking worden genomen.

Deze klachten schorsen de betalingsverplichting niet op.

Art. 11

Al onze overeenkomsten zijn onderworpen aan de Belgische wet en de rechtbanken van Brussel zullen in het geval van een geschil bevoegd zijn. Deze rechtbanken worden uitdrukkelijk door de partijen erkend als exclusieve bevoegdheid hebbende en geaccepteerd.

Elk geschil zal worden beslecht door het Scheidsgerecht aangeduid door het Instituut voor Arbitrage (www.euro-arbitration.org), volgens het reglement van arbitrage SDR (Standard Dispute Rules). Deze bepaling vervangt alle hiermee strijdige bevoegdheidsclausules.

Art. 12

Alle kosten in verband met de invordering langs gerechtelijke weg, inclusief honoraria van de raadsman, zullen ten laste van de koper worden verhaald.

Art. 13

Dit document werd oorspronkelijk opgemaakt in het Nederlands. In het geval van discrepanties in de anderstalige versies, dan zal de Nederlandse versie doorslaggevend zijn.

Art. 1

The present conditions govern all agreements between CCSI advice BV and its customers, to the extent not otherwise stipulated by special terms or agreements. Each order means the customer acceptance of our terms and conditions.

Art. 2

The applicability of any purchase or other conditions of the other party is expressly excluded.

Art. 3

If one or more provisions of these terms and conditions at any time be declared totally or partially invalid, the other provisions of these terms and conditions shall remain fully applicable. Seller and buyer will mutually establish new rules to replace the annulled provisions, as far as possible the purpose and intent of the original provisions are observed.

Art. 4

If there is uncertainty about the interpretation of one or more conditions of these terms and conditions, it will take place in the spirit of these conditions.

Art. 5

After confirmation it is not possible to cancel a planned coaching / consulting session at the latest within 48 hours. Cancellation done by phone or SMS always needs to be confirmed by email. With any later cancellation the full fee will be charged for the scheduled time. Coach / consultant, coachee / client and customer of course adhere to the agreements.

Art. 6

All invoices are payable 7 days after the invoice date unless a different term is agreed, in euro.

Art. 7

Per month, a new invoice is sent. All proposed payments must be paid within the invoice date provided.

Art. 8

In case of non-payment or late payment the price will ipso jure and without any notice is required be increased by a lump sum compensation of 15%, with a minimum of € 100.00.

Moreover, ipso jure and without any notice is required to pay an interest for late payment that will be calculated in accordance with the Law of August 2, 2002 on late payment in commercial transactions (traders). For private persons a late payment fee of 12% will be charged.

Art. 9

Any non-payment of an invoice by the due date or any default of payment brings exigibility of, even not expired, invoices that have already been made at that time and sent to the client and make any payment facility or discount for cash payment for the future automatic lapsed.

The seller can - in the absence of payment - rely on art. 1184 B.W.

Art. 10

All complaints regarding this invoice must reach CCSI advice BVBA by registered letter within 8 calendar days after the invoice date, with reference to the number of the invoice. After the lapse of this period, the complaint will not be taken into account.

These complaints do not suspend the payment obligation

Art. 11

All our agreements are subject to Belgian law and the courts of Brussels will be in the event of a dispute entitled. These courts are expressly recognized by the parties as having exclusive jurisdiction and accepted.

Any dispute will be settled by the Arbitral Court designated by the Institute of Arbitration (www.euro-arbitration.org), according to the SDR rules of arbitration (Standard Dispute Rules).

This clause replaces all conflicting jurisdiction clauses.

Art. 12

All costs associated with the recovery through legal actions, including legal fees, shall be recouped from the buyer.

Art. 13
